Has the FDA ever taken to court any fraudulent dietary supplement manufacturers?
Hello, I was wondering about the FDA and there responsibilities in regards to dietary supplements and those who break the laws regarding dietary supplements. After the whole ephedra fiasco, have certain manufacturers been sued because of health/safety issues, have people ever went to jail b/c of dangerous products. Can the FDA sue people b/c of dangerous products? After the few deaths from ephedra, was anyone sued/convicted? Any help would be awesome, KT
Usually, if there was going to be a lawsuit, it would be against the company. Also, the FDA would probably pursue criminal charges for fraudulent claims, not monetary suits (although they may include fines).
Typically the lawsuits put against these companies for money come from class-action lawsuits.
That being said, I believe there were convictions and jail time from the Ephedra issue.
